1. If the “Brand Fee” is a separate charge from the service charge Then this fee was not disclosed anywhere in the Groupon offer at the time I purchased the voucher. The addition of an undisclosed mandatory charge means the total price payable was not accurately presented at the point of sale, which is inconsistent with the transparency requirements under the Consumer Protection from Unfair Trading Regulations 2008. 2. If the “Brand Fee” is intended to be the same as the service charge mentioned in the deal terms The fine print clearly states that “A discretionary 10% service charge will be added to the bill.” I have attached the relevant section of the offer terms for reference. The term discretionary means the charge is optional. In practice, however, the restaurant treated this as a mandatory fee and required payment before allowing us to leave, which is inconsistent with the term disclosed in the Groupon listing. In either scenario, the charge applied during my visit does not correspond with the terms under which the voucher was sold on the Groupon platform. Given this experience, I have lost confidence in purchasing through Groupon.
